HTC possibly facing lawsuit, not by Apple this time Though

It has been while since we have seen any news on infringement lawsuits of any type aimed at a manufacturer. Not that they aren’t out there, but I think many of them are just being ignored by the media since it seems to be out of control. A new suit threat has surfaced that is just to darn good to pass up. No, it is not for software theft or pull down notifications. It isn’t aimed at a new tablet because it is a rectangle. The most recent suit to land on the doorsteps of HTC is based solely on a name. The HTC Vivid, which is one of AT&T’s newest 4G LTE devices, is under fire for the use of the name ‘Vivid’.

Some you may know where Vivid is used and who owns it, but others of you might not. Vivid entertainment is a large adult entertainment company. They are not so pleased to see their company name used on a device and are asking that it be changed immediately. They are claiming that it might cause branding confusion. I would think that it might generate more search results for them without any effort. When HTC was asked about the suit they had this to say in response –

We are reviewing the complaint and don’t expect to have any further comment until it is resolved.

Typical PR answers to a question. Does Vivid have any grounds to win this at all? Not really, but it sure puts them in the lime light a little. Maybe HTC could just offer the cast and crew all free Vivids or maybe a free DVD with each HTC Vivid purchase in a retail store. Wouldn’t that be something!

I am certain this will all be handled very quietly and discretely. This will probably be the only time we hear anything about it.
