The Android Open Source Mystery!

So what is considered open source and what is not?

Where do the boundaries of open source begin and end?

Cyanogens latest releases include AOSP branches from the google source and lots more.  Is the Android Market application the cause of Googles anger or is it something else?

Maybe we need to look at the contents of any builds available in the Android community and work out what is covered under the open source licenses and what is not.  I can understand that there maybe some proprietary applications but why would something that just helps to promote the Android Operating System be stopped when all it does is help the snowball effect get stronger.  Has anybody any clarity on the Android Open Source mystery?
