Nexus One 3G Connection Appears to be a Hardware Design Flaw

The guys over at Engadget posted a video a few days ago that shows a Nexus One dropping it 3G connection depending on how you hold the phone.  It sure appears like the Nexus One has some form of hardware design issue that needs to be addressed ASAP by HTC / Google.

I think T-Mobile can be let off the hook for this one if the video has any validity to it.

So now what happens to a phone that has a severe hardware design issue and all those people who have invalidated their phone warranty by unlocking the boot loader?  I think we need some form of official comment from HTC or Google on the status of this issues and the contents of this video
