Throttled AT&T user takes them to court and wins $850

The continued coverage of AT&T and the recent uproar in their throttling policy has led to some seriously upset people. The throttling as you may well be aware of by now, only affects the top 5% of the heavies data users that still reside on the grandfather unlimited plan. AT&T was quick to combat the media frenzy with a statement that only the top 1% of those 5% are actually put on restriction. It wasn’t the throttling that put users like unemployed Matt Spaccarelli in a foul mood. It was the specific amount of data that AT&T was throttling at. The range is between 1.5 to 2Gb of usage. You can understand why, when a new customer can have 3GB of data and not be throttled, people are upset.

While AT&T’s contracts strictly forbid users from coming together and filing a class action lawsuit, that doesn’t mean you can;t take them on solo. Matt sure as heck did. He took his claim and his argument to small claims court in Simi Valley. Judge Russell Nadal over saw the case and agreed with Matt and awarded him $850. At least there is one person out there willing to stand up to AT&T instead of just sitting back complaining.

We fully expect the news of a single victory to fly through the ranks of the world and social networks. It should spur hundreds if not thousands of cases from around the U.S. Matt’s victory is just the tip of the ice berg and his meager $850 could end up looking like peanuts by the time customers get through with AT&T. The damage is already done and the people do have a fighting chance.
